This privacy policy (“Privacy Policy”) along with the Terms of Use and Service https://www.ignitingminds.org/Terms-conditions (“Terms of Use”), constitute a legally binding agreement (this “Agreement”) between Igniting Minds Organization, a company duly incorporated under the provisions of the Companies Act, 2013 (herein referred to as “Igniting Minds”, “Our”, “We”, “Us”) and the User (“You”, “User”, “Your”) with respect to Your use of Our mobile Application / Website (collectively “Platform”) and Services.

The Platform is a platform that facilitates (i) online purchase of saplings/trees planted by Igniting Minds; (ii) online purchase of merchandise sold by igniting minds, branded post sourcing from “Third Party Manufacturers”; (iii) providing health data obtained from Google Fit/Apple HealthKit or any other third party health & fitness services providers (iv) providing corporates with products under CSR activities; (v) online advertisements of various sponsors advertising and marketing their own good and services (“Third Party Advertisers”). The Third-Party Manufacturers and the Third-Party Advertisers are collectively referred to as the “Third Party Service Providers”. Further the Platform also serves as an information platform providing environmental impact, health and wellness related information to the Users accessing the Platform (The services of Third-Party Services Provider and the information services is collectively referred to as the “Services”).

BACKGROUND

1. We take the privacy of Our Users very seriously and are committed to safeguarding their privacy while providing a personalized and valuable access to Our Platform.
2. You agree and understand that access to Services is conditional upon Your approval of this Privacy Policy. You agree that Your use of Services includes Your consent to collection, retention and use of Your information in accordance with the terms of this Privacy Policy and as per the Applicable Law.
3. No Information Collected through the Platform is rented or sold to any third party by Us, unless expressly stated otherwise. When You use Our Services, a high standard of security is maintained by Us in respect of Information Collected from You, however, you agree and understand that transmission of information via the internet or telephone networks is not completely secure. While We do Our best to protect the Information Collected, particularly Your Personal Information, we cannot ensure the security of Your data transmitted via the internet, telephone or any other networks which are not in Our control.
4. 4. The purpose of the Platform and Services is to provide an online Platform and medium to its Users to achieve their environmental protection goals through various products & services offered on the Platform. Igniting Minds is also engaged in various activities for promoting an environmental consciousness and healthy lifestyle, including providing environment, global climate, health, fitness and lifestyle related blogs, listing of tree plantation projects, volunteer centres, other environmental activists/NGO’s and government representatives and professional experts including, but not limited to, doctors, scientists (“Service Providers / Third Party Service Providers”), to enable the Users to track their environmental impacts, tree plantation drives, fitness tracking services and setting health goals. The arrangement between the Service Providers and Igniting Minds shall be governed in accordance with this Privacy Policy and the Terms of Use. The Services would be made available to such natural persons who have agreed to become buyers on the Website after obtaining due registration, in accordance with the procedure as determined by Igniting Minds, from time to time (referred to as “You” or “Your” or “Yourself” or “User”, which terms shall also include natural persons who are accessing the Website merely as visitors). The Services are offered to the Users through various modes which shall include issue of virtual coins/currency/credits, discount coupons and vouchers that can be redeemed for various goods/ services offered for sale by the Sellers.
5. While we try our best to provide security that is commensurate with the industry standards, because of the inherent vulnerabilities of the internet, we cannot ensure or warrant complete security of all information that is being transmitted to us by you.
6. For the purpose of providing the Services and for other purposes identified in this Privacy Policy, Igniting Minds will be required to collect and host certain data and information of the Users. Igniting Minds is committed to protecting the Personal Information of the Users and takes all reasonable precautions for maintaining confidentiality of the User’s Personal Information.
7. This Privacy Policy shall apply to the use of the Website and Mobile application by all Users / Sellers. Accordingly, a condition of each User's use of and access to the Website, Mobile application and to the other services provided by Igniting Minds to Users is their acceptance of this Privacy policy. Any User is required to read and understand the provisions set out herein prior to submitting any Sensitive Personal Data or Information to Igniting Minds, failing which they are required to leave the Website and/or Mobile Application immediately
8. This Privacy Policy is published in compliance of the (Indian) Information Technology Act, 2000 and the rules, regulations, guidelines and clarifications framed thereunder, including the (Indian) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
9. Please note that, with your consent, we will collect information about your location and physical movements in order for the Igniting Minds App to function properly and monitor and verify forms of eligible movement. You may turn location monitoring on and off from time to time using the settings of your operating system of your mobile device but, if you disable this functionality, we will not be able to collect information relating to your step-count and GPS/Cell-ID location which will prevent tracking and/or conversion of your movement into Sweatcoins.
10. We work with third parties from time to time (including, for example, Apple HealthKit, Google Fit, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers and search information providers who may provide us information about you.

INFORMATION COLLECTED

1. In order to provide Services, we automatically track and collect the following categories of information when You access and/ or use the Platform ("Traffic Data”):
   1. IP addresses;
   2. Domain server details; and
   3. Other information with respect to Your device, interaction of Your device with the Platform, other websites and applications.
2. In order to provide the Services, we may require You to provide Us with certain information that personally identifies You ("Personal Information"). Personal Information includes the following categories of information :
   1. Contact details, including but not limited to telephone number and e-mail address;
   2. Demographic data (such as time zone, postal address and location details); and
   3. Health data, including but not limited to daily physical activities provided by the Operating system of the devices used to access the platform.
3. You agree and understand that if You communicate with Us by, for example, e-mail or letter or telephone, any information provided in such communication may be collected, retained and used by Us as per the terms of this Privacy Policy.
4. We may transfer alphanumeric identifiers to Your device through Your web browser to enable Our systems to recognize Your browser, remember information specific to You and/ or provide certain features to You (“Cookies”). We may place both permanent as well as temporary Cookies in Your device, however, such Cookies shall not contain any of Your Personal Information. We do not control and are not liable for any Cookies placed by third parties on Your device
5. Traffic Data, Personal Information and such other information as may be collected pursuant to this Privacy Policy, together constitute the information collected by Us pursuant to Your use of Our Platform and/ or Services (“Information Collected”).
6. “Sensitive Personal Data or Information” means Personal Information of any individual relating to password; financial information such as bank account or credit card or debit card or other payment instrument details; physical, physiological and mental health condition; sexual orientation; medical records and history; biometric information; any detail relating to the above as provided to or received by Igniting Minds for processing or storage. However, any data/ information relating to an individual that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law shall not qualify as Sensitive Personal Data or Information. (“Sensitive Personal Data”).
7. Igniting Minds does not knowingly collect Personal Information from children.
8. Igniting Minds may in future include other optional requests for information from the User including through user surveys in order to help Igniting Minds customize the Website to deliver personalized information to the User and for other purposes are mentioned herein. Such information may also be collected in the course of contests conducted by Igniting Minds. Any such additional Personal Information will also be processed in accordance with this Privacy Policy.
9. Igniting Minds may in future include other optional requests for information from the User including through user surveys in order to help Igniting Minds customize the Website to deliver personalized information to the User and for other purposes are mentioned herein. 10. When you use the Services for placing order(s) or delivery, we collect precise location data (GPS and network-based). If you permit the Igniting Minds app/website to access location services through the permission system used by your mobile operating system ("platform"), we may also collect the precise location of your device when the app is running in the foreground or background to send retail store's promotion. We may also derive your approximate location from your IP address in order to make the app/website faster (“Location Information”).
11. When you use the pedometer function of the platform, we collect the health activities data of your device, namely “steps”. If you permit the Igniting Minds app/website to access health activities services through the permission system used by your mobile operating system ("platform"), we collect the “steps” of your device motion information when the app is running in the foreground or background.
12. We may collect information about your mobile device, including, for example, the hardware model, operating system and version, software and file names and versions, preferred language, unique device identifier, advertising identifiers, serial number, device motion information, and mobile network information to retrieve running apps and to improve performance. We may access information to find accounts on the device such as directly call phone numbers, read phone status and identity. (“Device Information”).
13. If you permit the Igniting Minds app/website to access the address book on your device through the permission system used by your mobile platform or website, we may access and store names and contact information from your address book on the device to facilitate social interactions through our Services. We may use the said information to check if the user is connected with network or not and to let user call in case if user taps on contact number (“Contacts Information”).
14. If you are a Service Provider and would like to engage with Igniting Minds, we will collect your business name, telephone number, address, zip code, service description. In addition, you may provide (not mandatory) other information about your business. We may also collect payment information from you. (“Service Providers Information”).
15. Igniting Minds reserves the right to record conversations between service providers and users which is facilitated by Igniting Minds through chat/messaging mechanism on the platform or calls made through virtual numbers which are provided to safeguard the privacy of consumers and service providers. All the chats/logs/messaging can be used but are not limited to monitor and prohibit abuse, safeguarding the rights of consumers and service providers, resolution of disputes, inter alia.
16. If it deemed necessary, then at or sole discretion, we may ask and collect supplementary information from third party service providers, such as – credits from a bureau, verification of identification details.

USE OF INFORMATION COLLECTED

1. 1. We use the Information Collected in such manner that enables Us to provide the Platform, Services and/ or any parts thereof to You in an effective way, including using Information Collected to:
   1. assist You in accessing the Services and/ or any part(s) thereof;
   2. contact and communicate with You from time to time for the provision of Services;
   3. prevent any potentially illegal activity and to screen and prevent undesirable or abusive activity during provision of Services and/ or any part thereof;
   4. monitor, maintain, troubleshoot and/ or improve the Services and/ or any associated features, including evaluation of or devising new features for the Platform;
   5. perform statistical and/ or other analysis of the Information Collected;
   6. analyze and measure Your activity, behavior and trends
   7. use Read_Phone_State permission to check if Your device is connected to the internet or not ; and/ or
   8. audit Your usage of Our Platform or Services
   9. Registration of the User on the Website
   10. Processing the User’s orders / requests and provision of Services (including provision of safe Services).
   11. Completing transactions with Users effectively and billing for the products/ Services provided
   12. Ensuring that the Website content is presented to the Users in an effective manner
   13. Delivery of personalized information and target advertisements to the User
   14. Improvement of Services, features and functionality of the Website along with Technical administration and customization of Website
   15. In case of any contests conducted by Igniting Minds in which the User participates, the User Information may be used for prize fulfilment and other aspects of any contest or similar offering
   16. Communicate any changes in our Services or this Privacy Policy or the Terms of Use to the Users
   17. Investigating, enforcing, resolving disputes and applying our Terms of Use and Privacy Policy, either ourselves or through third party service providers
   18. We may combine aggregate data with the personal information that we collect about you.
2. In addition to Clause 1 above, we may use the Information Collected (including Personal Information in aggregated form) to aid strategic development, data collection and analytics with respect to Platform and/ or Services provided by Us and to manage Our relationships with Our Service Providers or any third parties
3. The Information Collected shall not be used in any form or manner other than as is described in this Privacy Policy, specifically this clause (USE OF INFORMATION COLLECTED) of this Privacy Policy, and, while We use Our best efforts to protect all Information Collected, this Privacy Policy is not intended to restrict Our use of Information Collected (“Permitted Use”).
4. From time to time, Igniting Minds may use personal information for new and unanticipated uses which are not previously disclosed in the Privacy Policy. If our information practices change regarding information previously collected, then Igniting Minds shall make all reasonable efforts to provide notice and obtain consent of any such uses as maybe required by the law.

DISCLOSURE AND TRANSFER OF INFORMATION COLLECTED

1. Notwithstanding anything else contained in this Agreement, we do not disclose any personally identifiable Personal Information to any third parties, other than to the Service Providers to assist them in providing the best Services to You.
2. Igniting Minds makes all User Information accessible to its employees and data processors only on a need-to-know basis. All Igniting Minds employees and data processors, who have access to, and are associated with the processing of User Information, are obliged to respect its confidentiality.
3. Non-personally identifiable information may be disclosed to third party ad servers, ad agencies, technology vendors and research firms to serve advertisements to the Users. Igniting Minds may also share its aggregate findings (not specific information) based on information relating to the User’s internet use to prospective, investors, strategic partners, sponsors and others in order to help growth of Igniting Minds's business.
4. Igniting Minds may also disclose or transfer the User Information, to another third party as part of reorganization or a sale of the assets or business of an Igniting Minds corporation division or company. Any third party to which Igniting Minds transfers or sells its assets will have the right to continue to use the Personal Information and/ or other information that a User provide to us.
5. Igniting Minds may need to disclose/ transfer User’s Personal Information to the following third parties for the purposes mentioned in this Privacy Policy and the Terms of Use which are -
   1. to our affiliates in India or in other countries who may use and disclose your information for the same purposes as us.
   2. to government institutions/ authorities to the extent required (i) under the laws, rules, and regulations and/ or under orders of any relevant judicial or quasi-judicial authority; (ii) to protect and defend the rights or property of Igniting Minds; (iii) to fight fraud and credit risk; (iv) to enforce Igniting Minds 's Terms of Use (to which this Privacy Policy is also a part) ; or (v) when Igniting Minds , in its sole discretion, deems it necessary in order to protect its rights or the rights of others.
   3. If otherwise required by an order under any law for the time being in force including in response to enquiries by Government agencies for the purpose of verification of identity, or for prevention, detection, investigation including cyber incidents, prosecution, and punishment of offences.
   4. To Sellers and other service providers appointed by Igniting Minds for the purpose of carrying out services on Igniting Minds’s behalf under contract. Generally, these contractors do not have any independent right to share this information, however certain contractors who provide services on the Website, including the providers of online communications services, will have rights to use and disclose the Personal Information collected in connection with the provision of these services in accordance with their own privacy policies.
6. Subject to Clause 1 above of this section, we use Our best efforts to use personally identifiable Personal Information in aggregate form so that no individual Person is identified by the third parties with which such information is shared
7. We reserve the right to disclose any Information Collected if, in Our reasonable opinion, such disclosure is
   1. required by Applicable Law; or
   2. necessary to protect and defend Our or Our Users’ rights, property and/ or personal safety; or
   3. a Permitted Use.
8. All the information collected/ stored under this Privacy Policy and Terms of Use is maintained by Igniting Minds in electronic form on its equipment, and on the equipment of its employees. User Information may also be converted to physical form from time to time. Regardless of the manner of storage, Igniting Minds will keep all User Information confidential and will use/ disclose it only the manner specified under the Privacy Policy and Terms of Use.
9. Igniting Minds will also ensure that User Information is not kept for a period longer than is required for the purposes for which it is collected or as required under any applicable law.
10. Part of the functionality of the Website is assisting the Sellers to maintain and organize such information to effect sale and purchase of products. Igniting Minds may, therefore, retain and submit all such records to the appropriate authorities, or to Sellers who request access to such information.

CONFIDENTIALITY

1. 1. We use Our best efforts to keep confidential any Information Collected which is marked confidential or may be of confidential nature in Our opinion, with the exception of such information which
2. a. was already known to Us prior to collecting such information from You;
3. b. was received from a third party which is not subject to similar confidentiality restrictions;
4. c. is independently developed by Us; and/ or
5. d. is permitted to be disclosed under the Applicable Law.
6. 2. Except as otherwise provided in this Privacy Policy, we will keep all the Personal Information private and will not share it with third parties, unless We have a bona fide belief that such disclosure is necessary for Permitted Use or to:
7. a. comply with a court order or any other legal process;
8. b. protect Our, Our employees’, Users’ or third parties’ rights, property and/ or safety;
9. c. enforce the Agreement; and/ or
10. d. respond to any claims.
11. 3. The User is responsible for maintaining the confidentiality of the User's account access information and password. The User shall be responsible for all uses of the User's account and password, whether or not authorized by the User. The User shall immediately notify Igniting Minds of any actual or suspected unauthorized use of the User's account or password.

SECURITY

1. 1. The security of any Personal Information is important to Us. To protect Personal Information during transmission and upon receipt, we follow generally accepted industry standards and seek to ensure compliance with the Applicable Laws, including the Information Technology Act, 2000 and the rules made thereunder.
2. 2. Although We make best possible efforts to transmit and store all the Information Collected in a secure operating environment that is not open to public, you understand and acknowledge that there is no such thing as complete security and We do not guarantee that there will be no unintended disclosures of any Information Collected.
3. 3. If We become aware that any of Your Information Collected has been disclosed in a manner that is not in accordance with this Privacy Policy, we will use the best efforts to notify You of the nature and extent of such disclosure (to the extent We know that information) as soon as reasonably possible and as permitted by Applicable Law.
4. 4. Pursuant to Your use of Services, you may access links to third party websites or applications, including advertisements and/ or promotions. The privacy policies of such third-party links are not under Our control, hence once You leave Our servers, use of any information provided by You will not be governed by this Privacy Policy.
5. 5. You hereby acknowledge that Igniting Minds is not responsible for any intercepted information sent via the internet, and you hereby release us from any and all claims arising out of or related to the use of intercepted information in any unauthorized manner.
6. 6. Igniting Minds takes adequate steps to ensure that third parties to whom the Users’ Sensitive Personal Data or Information may be transferred adopt reasonable level of security practices and procedures to ensure security of Personal Information.

UPDATES AND CHANGES TO PRIVACY POLICY

1. 1. We reserve the right, at any time, to add to, change, update, or modify this Privacy Policy so please review it frequently. We will endeavour to inform You of any changes incorporated in this Privacy Policy that are significant (in Our opinion), however, you are requested to regularly visit and review this page.

YOUR ACCEPTANCE AND RIGHTS

1. 1. You accept this Privacy Policy by accepting the Agreement and/ or accessing the Services.
2. 2. You have a legal right to a copy of Your Personal Information held by Us and to correct any errors in such Personal Information. You also have a right to request that We cease to use Your Personal Information for direct marketing purposes, unless agreed to the contrary under the Agreement.
3. 3. You may approach, Grievance Officer, as to address any queries, concerns, discrepancies or grievances with respect to Your Information Collected or this Privacy Policy. We will use Our best efforts to redress the grievances expeditiously, within 1 (one) month from the date of receipt of such grievance.

USER RIGHTS IN RELATION TO PERSONAL INFORMATION COLLECTED

1. 1. All the information provided to Igniting Minds by a User, including Sensitive Personal Data or Information, is voluntary. User has the right to withdraw his/ her/ its consent at any time, in accordance with the terms of this Privacy Policy and the Terms of Use, but please note that withdrawal of consent will not be retroactive.
2. 2. Users can access, modify, correct and delete the Personal Information provided by them which has been voluntarily given by the User and collected by Igniting Minds in accordance with this Privacy Policy and Terms of Use. However, if the User updates his/ her information, Igniting Minds may keep a copy of the information which User originally provided to Igniting Minds in its archives for User documented herein. In case the User seeks to update or correct, his/ her Personal Information, the User may exercise these rights by emailing Igniting Minds and communicate the change(s) for updating Igniting Minds’s records.
3. 3. If a User, as a casual visitor, has inadvertently browsed any other pages of this Website prior to reading the Privacy Policy and the Terms of Use, and such User does not agree with the manner in which such information is obtained, stored or used, merely quitting this browser application should ordinarily clear all temporary cookies installed by Igniting Minds. All visitors, however, are encouraged to use the "clear cookies" functionality of their browsers to ensure such clearing/ deletion, as Igniting Minds cannot guarantee, predict or provide for the behavior of the equipment of all the visitors of the Website.

If a User has inadvertently submitted any Personal Information to Igniting Minds prior to reading the Privacy Policy and Terms of Use, and such User does not agree with the manner in which such information is collected, stored or used, then such User can ask Igniting Minds , by sending an email @ eic@ignitingminds.in containing the rectification required, whether Igniting Minds is keeping Personal Information about such User, and every User is also entitled to require Igniting Minds to delete and destroy all such information relating to such user (but not other Users) in its possession.
5. 5. In case the User does not provide his/ her information or consent for usage of Personal Information or subsequently withdraws his/ her consent for usage of the Personal Information so collected, Igniting Minds reserves the right to discontinue the services for which the said information was sought
6. 6. Igniting Minds shall not be responsible in any manner for the authenticity of the Personal Information or Sensitive Personal Data or Information supplied by the User to Igniting Minds or any Seller. If a User provides any information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or Igniting Minds has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Igniting Minds has the right to suspend or terminate such account at its sole discretion.
7. 7. Igniting Minds shall not be responsible for any breach of security or for any actions of any third parties that receive Users' Personal Information or events that are beyond the reasonable control of Igniting Minds including, acts of government, computer hacking, unauthorized access to computer data and storage device, computer crashes, breach of security and encryption, etc.
8. 8. When you share an article or a post (e.g., an update, image, video or article) publicly it can be viewed by everyone and re-shared anywhere (subject to your settings). Members, Visitors and others will be able to find and see your publicly-shared content, including your name (and photo if you have provided one).

Children’s Privacy

We do not aim any of our products or services directly at children under the age of 13 and we do not knowingly collect personal information about children under 13.

Business Transfers

If we or our assets are acquired, or in the unlikely event that we go out of business or enter bankruptcy, we would include data, including your personal information, among the assets transferred to any parties who acquire us. You acknowledge that such transfers may occur and that any parties who acquire us may, to the extent permitted by applicable law, continue to use your personal information according to this policy, which they will be required to assume as it is the basis for any ownership or use rights we have over such information.

Our app may access and collect data via your device's in-built tools, such as

3. Background data refresh

When you install the app or use your device’s tools within the app, we request permission to access this information. The specific data we collect can depend on the individual settings of your device and the permissions you grant when you install and use the app.

ANNEX 1 – PURPOSES OF COLLECTING PERSONAL INFORMATION

The Igniting Mind App’s use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

We use the following categories of personal data in the manner specified below, and rely on the following legal basis for processing:

1. Contact Details (phone number): We use this data to verify your identity as part of our account set up procedure. Our legal basis for processing this data is because it is in our and your legitimate interests to ensure that you have used the correct phone number when signing up for the Services.
2. Contact Details (email address, phone number etc.), profile information (username, profile photo, bio etc.), movement data (motion data, Google Fit data, HealthKit data): We use this data to provide the Services, including the Igniting minds Eco-coins (coins can be used to redeem trees and remains our primary purpose). Our legal basis for processing this data is based on rewarding the user with trees.
3. Location Data (iOS only): We use this data to verify your physical movement and location and issue Igniting Minds Eco-coins on the basis of this verified data. Our legal basis for processing this data is based on consent (where we are processing location data and HealthKit data for rewarding user with trees).
4. Movement data (Healthkit / Google Fit steps data): We use this data to verify your physical movement and issue Igniting Minds Eco-coins on the basis of this verified data. Our legal basis for processing this data is based on consent (where we are processing location data and HealthKit data for rewarding user with trees).
5. Contact Details (email address, phone number etc.), payment details (card number, CVC etc.), profile information (username): We use this data to process your transactions with us.
6. Profile Information (username, profile photo etc.), movement data (motion data, HealthKit data, Google Fit data): We use this data to create daily leader boards of users, comprising all users or users meeting particular criteria as ranked by the number of steps completed or using other criteria. Our legal basis for processing this data is because it is in our legitimate interests to make our services social and competitive and allow you to see how you rank against other users and encourage you to walk more.
7. Contact Details (phone number): We use this data to connect you with other users and allow you to invite contacts to use the Services. Our legal basis for processing this data is because it is in our legitimate interests to make our services social and allow you to interact with friends when using the Services.
8. Transaction Data and Order History: We use this data to understand your preferences and maintain accounts and records. Our legal basis for processing this data is that it is in our legitimate interests to provide users with their historical data.
9. Profile Information (username, profile photo, bio etc.), usage data, transaction Data, movement data (motion data, HealthKit data, Google Fit data): We use this data to investigate and/or prevent suspected fraud or other criminal activities, to investigate disputes between users, and for Statistical analysis to help us manage our business, e.g. in relation to our financial performance, customer base, product range or other efficiency measures. Our legal basis for processing this data is because it is in our legitimate interests to resolve and protect ourself and users of the Services, the Igniting Minds App and the Websites against harmful activities; it is in our legitimate interests to ensure that disputes between users are resolved and appropriate action is taken against users breaching the rules; and because it is in our legitimate interests to be as efficient as we can so we can deliver the best services to you.
10.
